SECTION 39
39. Offences and penalties
(1) Any person who –
(a) contravenes or fails to comply with any provision of this By-law or disobeys any instruction or written compliance notice by an authorised official enforcing this By-law; or
(b) obstructs or hinders any person in the execution of any power or the performance of any duty or function in terms of any provision of this By-law; or
(c) conceals any animal or refuses to hand over any animal to an authorised official in the execution of his or her powers in terms of this By-law; or
(d) removes or attempts to remove, by threats of violence or otherwise, from the person or persons in charge of any animal being lawfully brought to the pound, or removes or attempts to remove any animal after such animal has been lawfully impounded or seized by an authorised official; or
(e) furnishes false, incorrect or misleading information when applying for permission from the City in terms of a provision of this By-law; is guilty of an offence and liable to a fine, or upon conviction is liable to a period of imprisonment for a period not exceeding two years, or to both such fine and imprisonment.
