SECTION 41
41. Search, seizure and entry of premises
(1) An authorised official may, for the purposes of enforcing this By-law―
(a) enter any premises with the consent of the owner or occupier to determine whether an offence under this By-law has been committed.
(b) where such consent is not granted or is denied, the authorised official may apply to a Magistrate having jurisdiction for:-
(i) an entry warrant to enter and inspect the premise to determine compliance with any of the obligations under this By-law,
(ii) a search and seizure warrant to seize and impound any animal, article, or item that is, or is reasonably suspected to be, connected with the commission of an offence under this By-law
(2) Any warrant granted under subsection 1(b) may, on application and on good cause shown by any affected party, be revoked by a Magistrate having jurisdiction in the district in which such warrant was granted.
(3) Any authorised official may use reasonable and necessary force, during execution of any warrant issued in terms of this section, to gain entry or to seize any animal, article or item that is, or that is reasonably suspected to be, connected with the commission of an offence under this By-law.
