SECTION 42

42. Search and Seizure without a warrant

(1) An authorised official may, for the purposes of enforcing this By-Law conduct a search of any premises, person, vehicle, or structure without a search warrant for the purpose of seizing any animal, article, or item reasonably believed to be connected with the commission of an offence under this By-law, if—

   (a) the person does not consent, but the authorised official, on reasonable grounds, believes that—

      (i) A search and seizure warrant would be issued under subsection 36(1)(b) of this By-Law or in terms of section 21(1)(a)of the Criminal Procedure Act, 1977 (Act No. 51 of 1977) if an application were made; and

(2) The delay in obtaining the warrant would defeat the object of the search.
